Terms of Service

Please read these Terms of Service carefully before using deepcloud. These terms constitute a legally binding agreement between you and deepcloud Inc.

1. Acceptance of Terms

By accessing or using deepcloud, you agree to be bound by these Terms of Service and all applicable laws. If you do not agree, do not use the service. These terms apply to all users, including free and paid plan holders.

2. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 13 years old to use deepcloud. One person may not maintain multiple accounts.

3. Acceptable Use

You agree not to: upload illegal, harmful, or infringing content; attempt to gain unauthorized access to other accounts or systems; use the service for spam, phishing, or malware distribution; reverse-engineer our encryption or security systems; resell or sublicense your account; or interfere with the service's operation.

4. Storage and Data

Your storage quota is determined by your plan. Exceeding your quota may result in inability to upload new files. We reserve the right to remove content that violates our policies. We are not responsible for data loss caused by your actions.

5. Payment and Billing

Paid plans are billed monthly or annually via Stripe. All prices are in USD unless otherwise stated. Annual plans offer a 20% discount. We offer a 30-day money-back guarantee for new paid plan subscriptions. Refunds after 30 days are at our discretion.

6. Cancellation and Termination

You may cancel your subscription at any time. Upon cancellation, you retain access until the end of the billing period. We may terminate accounts that violate these terms with or without notice. Upon termination, your data is deleted within 30 days.

7. Digital Inheritance Features

deepcloud provides digital inheritance tools as a convenience feature. We are not a licensed estate planning service or legal advisor. Inheritance features should be used in conjunction with professional legal estate planning. We are not liable for inheritance disputes or failures due to incorrect configuration.

8. Intellectual Property

deepcloud and its logos, designs, and software are protected by copyright and trademark law. You retain ownership of all content you upload. By uploading, you grant us a limited license to store and transmit your encrypted content to provide the service.

9. Disclaimer of Warranties

The service is provided 'as is' without warranties of any kind. We do not guarantee uninterrupted service, specific uptime levels (beyond our SLA commitments in paid plans), or that the service will meet all your requirements.

10. Limitation of Liability

To the maximum extent permitted by law, deepcloud shall not be liable for indirect, incidental, special, or consequential damages exceeding the amount paid by you in the last 12 months. This limitation applies to all claims including negligence, warranty breach, and other causes.

11. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in San Francisco, CA, except for claims eligible for small claims court.

12. Changes to Terms

We may modify these Terms at any time. We will notify you via email at least 30 days before material changes take effect. Continued use after changes constitutes acceptance.
